Terms of Use

The following information includes the “Terms and Conditions” under which individuals seeking employment and career information (“Candidates”), and employers (“Employers”) and recruitment companies (“Recruiters”) seeking employees may use the Sites or any one of them. Users of the Sites are hereinafter collectively referred to as “Users” and individually as the “User”.

For greater clarification, the “Sites” refers to:

By using the Sites the User agrees to the Terms and Conditions stated here. BC Jobs Online Inc. (the “Company”) is entitled to amend the Terms and Conditions at any time without informing Users, by updating this page. It is the User’s responsibility to revisit this page periodically to ensure the receipt of updated information and Users are deemed to be aware of all amendments. Users who do not agree with amendments to the Terms and Conditions shall immediately stop using the Sites.

Subject to these Terms and Conditions, the Company gives the User the non-exclusive, non-transferable, limited right to access, use and view the Sites and the Content for the User’s own personal, noncommercial use.

For greater clarification, “Content” refers to all information, content, reports, data, databases, graphics, interfaces, web pages, text, files, software, product names, company names, trade-marks, logos and trade names contained on the Sites, including the manner in which the Content is presented or appears.

Unauthorized use of the Content may violate copyright, trademark and other laws. This includes (i) removing any copyright or other proprietary notices contained in the Content; (ii) selling, modifying, reproducing, publicly displaying or distributing Content for commercial use; (iii) using the Content on any other website with the exception of blogging and microblogging sites including, but not limited to Facebook, Twitter, LinkedIn, Digg, Wordpress, Blogger and other social media based sites where source information is credited; (iv) transferring the Content to any person without the written permission of the Company; (v) printing or copying the HTML code that is used to generate the Company’s pages; (vi) interfering with the security of the Sites or any services, system resources, accounts, servers or networks accessible through the Sites or affiliated Content or sites; (vii) disrupting another User’s use of the Sites; (viii) transmitting any Materials that would negatively effect the use of the Sites, including destructive files or programs that impose a large amount of Content on the Company’s website infrastructure, this includes submitting a virus to the Company, overloading, “flooding”, “spamming”, “mailbombing”, “crashing” etc.; (viii) using another User’s account or information without prior authorization from the Company; (ix) creating a false identity on the Sites; (x) transmitting any information through an unsolicited mass email; (xi) collecting information about others, including email/mail addresses, names, social media account information (including but not limited to Facebook, Twitter and LinkedIn) and phone numbers, except for the sole stated purposed provided by the Company; (xii) registering an email address for which the User does not have permission of the owner to register. Violations of system or network security may result in civil or criminal liability. The Company will investigate occurrences, which may involve violations to the above terms and conditions and may involve law enforcement authorities in prosecuting Users involved in such violations.

Acceptable use of the Sites includes: posting Content for the stated purposes while ensuring that all Content (i) is complete, accurate and represents the User’s own resume and job application materials; (ii) does not represent any multi-level marketing opportunity, membership, distributorship or business opportunity which requires to recruitment of other members or sub-agents; (iii) is added or deleted only with the consent of the User; (iv) is not unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful or otherwise undesirable by another User, group, community or congregation; (v) does not infringe or violate a third party’s copyright, trade mark, privacy or proprietary right that would violate any applicable law; and, (vi) is free of commercial or other advertisements intended to solicit business from Recruiters or Employers using the Sites, including solicitation by any competitors of Recruiters or Employers who post on the Sites.  Additional prohibited uses include (vii) posting jobs for modeling, talent or talent scouting positions; (viii) posting information that is copyrighted without the permission of the copyright owner; and (ix) posting material that is sexually-explicit. By using the Sites, Users agree that they are solely responsible for actions and communications undertaken in the course of the Sites’ usage and will abide by all laws that apply or may apply to a User’s activities on the Sites. The Company will investigate occurrences which may involve violations to the above terms and conditions and may involve law enforcement authorities in prosecuting Users involved in such violations.

The Company does not guarantee the truthfulness, accuracy or reliability of communications posted by Users or endorse any opinions expressed by Users. The Company thereby has no obligation to screen communications but will investigate any allegation presented where Terms and Conditions may be violated. The Company reserves the right to prohibit use of the Sites by any User who has violated the Terms and Conditions.

By submitting Content to any area of the Sites, Users grant the Company the non-exclusive right and license to use, reproduce, modify, publish, translate, distribute communicate or display the Content without any royalties or payment granted the User. By posting Content, the User completely and effectively waives all such rights.

Privacy

The Company recognizes that the growth of on-line services, including Internet services, has created additional privacy concerns, particularly for consumers. Accordingly, the Company has put in place the following On-line Privacy Policy. This policy covers the Sites.

On-line privacy concerns focus primarily on the protection of “customer identifiable” information which an individual or other customer reasonably expects to be kept private. As the term suggests, “customer identifiable” information is information that, when associated with an individual identifies that individual, for example, a customer’s name, address, telephone number, and e-mail address.

Collection and Use: the Company will collect and use customer identifiable information for billing purposes, to provide and change service, to anticipate and resolve problems with the User’s service, or to create and inform the User of products, services, and relevant job postings that better meet the User’s needs. This means that the Company may use the User’s customer identifiable information, in conjunction with information available from other sources, to market new services to the User that we think will be of interest to the User. The Company may share the User’s information among each of the Sites in order to advertise opportunities across a wider platform.

The User may opt out of receiving information regarding products, services and relevant job postings at any time. After opting out, the User will no longer receive information from the Company.

When the User accesses the Internet, the computers that host web sites the User visits (“web servers”) automatically receive some anonymous information. This “usage data” may include a record of which pages a web browser has visited. The Company’s servers receive usage data when the User visits the Sites, and when the User visits other sites as well. The Company may use usage data to provide advertising about goods and services that may be of interest to the User, or to provide customized features and services. The Company will not use information about the User’s activities on the Internet together with any information that identifies the User without the User’s consent.

Cross-postings: As a User of the Sites, the User needs to be aware of and agree to the User’s postings on any of the Sites being cross-posted on any other affiliate or subsidiary website of the Sites.

The Company and its advertisers may use various kinds of software devices to collect information about Internet use. Small files called “cookies” may be attached to the User’s Web browser. The User can set the User’s browser to disable cookies, but the Sites may not work properly if the User does so. The Company uses cookies for a variety of purposes in order to improve your online experience, for analytics and for marketing, but specifically the Company use cookies on the Sites for the following purposes:

Improper Conduct: the Company may also use customer identifiable information to investigate and help prevent potentially unlawful activity or activity that threatens the network or otherwise violates the customer agreement for that service.

Account Information: the Company honors requests from customers to review all customer identifiable information maintained in reasonably retrievable form, which currently consists of the User’s name, address, e-mail address, telephone number and/or billing information (if applicable), and will correct any such information which may be inaccurate. Customers may verify that appropriate corrections have been made.

Customer Concerns: If the User is a consumer with concerns about the Company’s on-line Privacy Policy or its implementation, please contact us.

The Company’s Liability

The Company offers a vehicle for Employers and Recruiters to post job positions and Candidates to post resumes and does not screen or censor the listings offered. The Company maintains a third party status and does not get involved in the actual transaction between Candidate and Employer or Recruiter. The Company has no control over the authenticity or legality of communications and Users need to be prepared to face risks associated with the Sites which may include, but are not limited to the risk of (i) physical harm, (ii) dealing with persons without the proper work permit or age requirement, or (iii)  dealing with persons acting under false pretenses or claiming to be someone else. The User accepts all risks associated in using the Sites and are urged to cautiously engage in contact established with other Users of the Sites. Content may contain inaccuracies or typographical errors. The Company does not claim that all Content submitted is accurate, reliable, complete or timely. The Company is not to be considered an Employer and is not responsible for any employment or hiring decisions made by an Employer or Recruiter posting jobs on the Sites.

THERE IS NO GUARANTEE THAT PERSONAL INFORMATION AND TRANSACTIONS ON THE SITES OR ON THE INTERNET WILL BE MAINTAINED CONFIDENTIAL AND SECURE. THE USE OF THE SITES AND THE CONTENT IS AT THE USER’S OWN RISK AND THE COMPANY ASSUMES NO LIABILITY OR RESPONSIBILITY PERTAINING TO THE CONTENT, THE USER’S USE OF THE SITES OR THE RECEIPT, STORAGE, TRANSMISSION OR OTHER USE OF THE USER’S PERSONAL INFORMATION.

Website Warranty

Users accept the risk that the Sites may not operate error-free nor that the Sites and its server are free of computer viruses. The Company assumes no liability for the servicing or replacing of equipment or data. The Sites are provided ‘as is’ without any kind of representations, warranties, guarantees, or conditions, of any kind whether express or implies, statutory or otherwise, including, but not limited to, warranties as to uninterrupted or error-free operation, availability, accuracy, completeness, currentness, reliability, timeliness, legality, suitability, privacy, security, merchantability, or fitness for a particular purpose.

Liability

IN NO EVENT WILL THE COMPANY, OR ITS AFFILIATES, DIRECTORS, OFFICERS, OR EMPLOYEES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, EXEMPLARY, AGGRAVATED, ECONOMIC OR CONSEQUENTIAL DAMAGES HOWSOEVER CAUSED, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF USE, LOST PROFITS, OR LOST SAVINGS, EVEN IF THE COMPANY OR ANY OF ITS LAWFUL AGENTS OR EMPLOYEES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIM.

IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, AGENTS, LICENSORS, SUPPLIERS, OR THEIR RESPECTIVE DIRECTORS, OFFICERS OR EMPLOYEES, BE LIABLE FOR DAMAGES OR LOSSES RESULTING FROM: VIRUSES, DATA CORRUPTION, FAILED MESSAGES, TRANSMISSION ERRORS OR PROBLEMS; TELECOMMUNICATIONS SERVICE PROVIDERS; LINKS TO THIRD-PARTY WEB SITES; THE INTERNET BACKBONE; PERSONAL INJURY; THIRD-PARTY CONTENT, PRODUCTS OR SERVICES; DAMAGES OR LOSSES CAUSED BY THE USER, OR THE USER’S RESPECTIVE EMPLOYEES, AGENTS OR SUBCONTRACTORS; LOSS OF USE OR LACK OF AVAILABILITY OF FACILITIES INCLUDING COMPUTER RESOURCES, ROUTERS AND STORED DATA; THE USE OR INABILITY TO USE THE SITES OR THE CONTENT; ANY OTHER WEB SITE ACCESSED TO OR FROM THE SITES; OR EVENTS BEYOND THE REASONABLE CONTROL OF THE COMPANY, EVEN IF THE COMPANY OR ANY OF ITS LAWFUL AGENTS, OR EMPLOYEES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIM.

Termination

Upon breach of these Terms and Conditions, the Company reserves the right, at its sole discretion, to delete the User’s postings and communication from the Sites and terminate the User’s registration and ability to access the Sites.

Indemnity

The User agrees to defend and hold harmless the Company, its ownership and employees, from any claims, actions or demands, alleging or resulting from the use or the misuse of the Sites, the Content or as the result of a breach of the Terms and Conditions.

The Company shall notify the User immediately if there is a claim or suit resulting from the above.

License of Use for Job Seekers

The Company offers a limited and non-exclusive right to use the Sites in seeking employment opportunities for personal purposes and cannot be used for commercial purposes including sourcing job postings for use by other websites, social media sites, blogs/microblogs, Recruiters or any third party, without the written consent of the Company. This includes job postings where an Employer or Recruiter have paid to post a career opportunity and does not include other Site Content including articles and workplace resources. Any User in violation of these Terms may have their use suspended or terminated at the sole discretion of the Company. Violations of system or network security may result in civil or criminal liability. The Company will investigate occurrences which may involve violations to the above terms and conditions and may involve law enforcement authorities in prosecuting Users involved in such violations.

License of Use by Employers and Recruiters

The Company offers a limited and non-exclusive right to use the Sites only for the User’s internal business use seeking Candidates for employment, as well as using the Content for Company learning and development. The User is not permitted to reproduce the Content for any commercial use, including reproduction or sale, with the exception of social media sites including Facebook, Twitter, LinkedIn, Digg, Wordpress or Blogger where source information is credited, or upon written authorization from the Company. The User is not allowed to transfer access to the Sites, Content or Candidates to any third party without written authorization of the Company. The User is also not allowed to access the personal information of Candidates except for contacting them in regards to employment opportunities. This includes using any contact or account information found for commercial use including email, mail, social media and related activities. Any User in violation of these Terms may have their use suspended or terminated at the sole discretion of the Company. Violations of system or network security may result in civil or criminal liability. The Company will investigate occurrences which may involve violations to the above terms and conditions and may involve law enforcement authorities in prosecuting Users involved in such violations.

License of Use by Others

The Company offers a limited and non-exclusive right to use the Sites’ features that are not account/password protected to any User unclassified as a Candidate, Employer or Recruiter. This may include but is not limited to journalists, economists, passive job seekers, company professionals, communications professionals, bloggers, social media experts etc. The User is not permitted to reproduce the Content for any commercial use, including reproduction or sale, with the exception of social media sites including Facebook, Twitter, LinkedIn, Digg, Wordpress or Blogger where source information is credited, or upon written authorization from the Company.

The User is also not allowed to access the personal information of job seekers except for contacting them in regards to employment opportunities. This includes using any contact or account information found for commercial use including email, mail, social media and related activities. Any User in violation of these Terms may have their use suspended or terminated at the sole discretion of the Company. Violations of system or network security may result in civil or criminal liability. The Company will investigate occurrences which may involve violations to the above terms and conditions and may involve law enforcement authorities in prosecuting Users involved in such violations.

Content and Resources

The opinions expressed in any Content that is not the property of the Company, including guest columnists/bloggers, comments, job postings, job seeker materials (including resume, cover letter and related material) and other material does not represent the views of the Company, its employees or ownership. The User guarantees that the Content submission does not violate any laws or proprietary rights, including but not limited to copyright, trademark, obscenity, rights of publicity or privacy and defamation laws. The User grants the Company the royalty-free license to use Content and to hyperlink to external web site(s). The Company is not responsible for any third party reproducing submitted Content that may violate any laws or proprietary rights.

Governing Law

This Agreement will be governed by the laws of the Province of British Columbia and the federal laws of Canada and shall be treated in all respects as a British Columbia contract, without reference to the principles of conflicts of law. In the event of a dispute, Users agree to submit to the non-exclusive jurisdiction of the British Columbia courts.

Refund Policy

Our commitment at QCjobcentre.ca is to provide exceptional services to our valued customers. We understand that circumstances may arise where a refund is requested. This refund policy outlines the conditions under which refunds will be provided.

  1. Eligibility for Refund:

    Refunds will be considered on a case-by-case basis.

    Customers must provide valid reasons for requesting a refund.

    Refunds are subject to the terms and conditions outlined in the initial service agreement.

  2. Refund Amount:

    The amount of refund granted will depend on the following factors:

    The extent to which the service has been utilized.

    The duration for which the service has been active.

    The specific services rendered to the customer.

    Any applicable fees or charges incurred during the provision of services.

  3. Refund Process:

    Customers requesting a refund must follow these steps:

    Contact our customer support team via email

    Provide relevant information regarding the reason for the refund request.

    Allow our team to assess the request and determine eligibility for a refund.

    If eligible, the refund amount and process will be communicated to the customer.

  4. Exceptions:

    Refunds may not be granted in the following cases:

    Clear evidence of fraudulent activity or misuse of our services.

    Failure to adhere to the terms and conditions outlined in the service agreement.

    Services that have been substantially utilized or expired.

  5. Scamming Prevention:

    We reserve the right to refuse a refund if it is determined that the customer is using our services for scamming purposes. Our team diligently monitors activities on our platform to ensure the integrity of our services and protect our users from fraudulent behavior.
